By accessing or using the Site, or by placing an order, you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Site.

1. About us

The Site is operated by Buddii Health, a business of Bootnox Pty Ltd (ABN 86 989 961 578), of 67 Howe St, Osborne Park, WA 6017, Australia (“Buddii Health”, “we”, “us”, “our”).

2. Eligibility

You must be at least 18 years old to purchase products from the Site. By placing an order, you confirm that you are at least 18.

The Site is intended for residents of Australia unless stated otherwise.

3. Not medical advice

+Bud­dii is a dietary supplement. It is not a medicine, and it is not intended to diagnose, treat, cure, or prevent any disease, medical condition, or addiction.

Information on this Site, on our packaging, or in our marketing:

  • is general in nature

  • is for informational purposes only

  • does not replace professional medical advice, diagnosis, or treatment.

Always:

  • read the label and follow the directions for use

  • consult a qualified health professional if you have any medical condition, are taking any medication, are pregnant, breastfeeding, or have questions about whether +Buddii is appropriate for you.

Do not rely on +Buddii to prevent or reduce intoxication, or to make it safe to drink and drive or operate machinery.

4. Responsible drinking

We do not promote excessive or irresponsible alcohol consumption. You are solely responsible for your decisions about if, when, and how much to drink.

+Bud­dii:

  • does not make you “safe to drive”

  • does not guarantee that you will avoid a hangover or any other effect of alcohol

  • is intended to support general wellbeing in the context of social occasions, including occasions with or without alcohol.

Always follow local laws related to alcohol use.

5. Product information and availability

We try to ensure all product descriptions, ingredients, images, and other information on the Site are accurate and up to date. However:

  • minor differences may occur between the actual product and images displayed

  • formulations, packaging, pricing, availability, and promotions may change without prior notice.

We may limit quantities of any product, refuse orders, or discontinue products at any time.

6. Pricing, taxes and currency

All prices on the Site are stated in Australian dollars (AUD) and, unless specified otherwise, include Goods and Services Tax (GST) where applicable.

We may change prices at any time without notice. The price you pay will be the price displayed at checkout at the time you place your order.

You are responsible for any additional taxes, duties, or charges imposed by your local authorities if ordering from outside Australia (if and when we ship internationally).

7. Orders and contract

When you place an order through the Site, you are making an offer to purchase the products in your cart under these Terms & Conditions.

A contract is formed only when:

  • you successfully complete checkout; and

  • we accept your order by sending an order confirmation email.

We reserve the right to:

  • refuse or cancel any order (for example due to stock issues, suspected fraud, mispricing, or error)

  • correct any errors or inaccuracies on the Site, including after you have placed an order.

If we cancel an order after you have been charged, we will issue a refund for the amount paid for the cancelled items.

8. Payment

We accept the payment methods displayed at checkout (for example, credit/debit card, PayPal, BNPL providers, or other gateways).

By providing payment details, you confirm that:

  • you are authorised to use the payment method

  • the information you provide is accurate and complete.

All transactions are subject to approval by the payment provider. We are not responsible for delays or refusals by payment providers.

9. Shipping and delivery

Shipping options, costs, and estimated delivery times are displayed at checkout and may vary by location.

Key points:

  • dispatch times are estimates only and are not guaranteed

  • once dispatched, orders are handled by third-party carriers; delays outside our control can occur

  • risk of loss and title for products pass to you upon delivery to the address you provide or upon collection (if applicable).

Make sure your shipping details are correct. We are not responsible for orders lost or delayed due to incorrect or incomplete addresses provided by you.

10. Returns, refunds and Australian Consumer Law

Your rights under the Australian Consumer Law (ACL) apply in addition to any policies set out here. Nothing in these Terms & Conditions excludes or limits your rights under the ACL.

Under the ACL, you may be entitled to a repair, replacement, or refund if a product is faulty, not fit for purpose, or does not match its description.

Due to the nature of dietary supplements and hygiene regulations:

  • we generally cannot accept returns of opened products unless required by law (for example, where there is a defect)

  • change-of-mind returns are only available if we state this clearly in a separate returns policy on the Site.

To seek a remedy:

  • we may request photos or other information to assess the claim.

If a refund is approved, it will be processed to your original payment method, subject to the payment provider’s timelines.

  • grant Buddii Health a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, adapt, publish, and display that content in any media for marketing, promotional, or other lawful purposes

  • confirm that you own or control the rights to that content and that your content does not infringe any third-party rights or applicable laws.

We may moderate, edit, or remove user content at our discretion.

18. No guarantees of outcome

  • specific performance outcomes

  • prevention or elimination of hangovers or other effects of alcohol

  • any particular health or wellbeing result.

Any statements about benefits are general in nature and based on ingredient properties and user feedback. Your experience may differ.

19. Limitation of liability

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law:

  • We exclude all warranties, representations, and conditions (express or implied) relating to the Site and products, except those that cannot lawfully be excluded.

  • Our liability to you arising out of or in connection with the Site, your order, or these Terms & Conditions is limited, at our option, to:

    • replacing the products or supplying equivalent products;

    • repairing the products;

    • paying the cost of replacing the products or acquiring equivalent products; or

    • paying the cost of having the products repaired.

We are not liable for:

  • any indirect, incidental, special, or consequential loss or damage

  • loss of profits, revenue, business, or data

  • any loss or damage arising from your misuse of products or failure to follow instructions, including irresponsible or excessive alcohol consumption.

Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

20. Indemnity

You indemnify and hold harmless Buddii Health, its directors, officers, employees, and agents from and against any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • your breach of these Terms & Conditions

  • your misuse of the Site or products

  • your violation of any law or the rights of any third party.

21. Changes to the Site and these Terms

We may update, modify, or discontinue any part of the Site, including these Terms & Conditions, at any time.

22. Governing law and jurisdiction

These Terms & Conditions are governed by the laws of Western Australia, and the laws of the Commonwealth of Australia that apply there.

You submit to the non-exclusive jurisdiction of the courts of Western Australia and the courts that may hear appeals from those courts.

23. Severability

If any part of these Terms & Conditions is held to be invalid, unlawful, or unenforceable, that part will be severed and the remainder will continue in full force and effect.

24. Entire agreement

These Terms & Conditions, together with any policies or notices referenced on the Site (including our Privacy Policy and any Shipping/Returns policies), form the entire agreement between you and Buddii Health in relation to your use of the Site and purchase of products.
